Policy compilation for March 2022
Import and Export Trade Statistics:
In March, 2022, Chinas total exports and imports grew by 7.5% year on year to 504.79 billion U.S. dollars, in which exports rose by 14.7% year on year to 276.08 billion U.S. dollars, after a 6.2% increase in February, while imports fell by 0.1% year on year to 228.70 billion U.S. dollars, after a 10.4% increase in February. The trade surplus expanded to 47.38 billion U.S. Dollars, up 302.1% year on year.
China exported 1.02 trillion yuan in mechanical and electrical products in March, with a year-on-year increase of 9.8% from January to March to 3.05 trillion yuan. In particular, 23.29 billion units of integrated circuits, worth 85.71 billion yuan, were exported in March, resulting in 246 billion yuan of total exports from January to March, up 20.8% compared to the same period last year. Exports of medical devices were 9.89 billion yuan in March. Thus the total exports thereof in the first three months of 2022 reached 28.81 billion yuan, up 3.5% from a year ago.
So far, the COVID-19 outbreak in Shanghai is still running at a high level. The situation remains severe and complicated. Every individual is hanging on, taking epidemic control and prevention measures every day and doing their job. In addition to that, the government has also taken some effective measures to reduce enterprises burden to make them keep functioning normally.

Shanghai Customs Several Measures to Confront the Epidemic, Ensure Peoples Livelihood, Help Enterprises, and Promote Development
For the purposes of implementing the important instructions of General-Secretary Xi Jinping on strict epidemic control and prevention in depth, following up the decisions and deployment of the General Administration of Customs resolutely, and fulfilling the requirements of Shanghais epidemic control and prevention, Shanghai Customs, supported by the large digital cross-border trade platform, will continue coordinating the epidemic control and prevention and the economic and social development, try its best to support Shanghai in winning the challenging battle of epidemic control and prevention and help enterprises and promote development. To achieve those goals, it has issued ten specific measures.

Observations
The measures include those to provide full support to ensure the safety and normal operation of Shanghai Port, make sure enterprises’ problems are responded to and resolved promptly, allow enterprises to postpone part of customs formalities, promote the carrying out of customs operations completely online, facilitate enterprises to the maximum, guarantee fast customs clearance for epidemic control and prevention materials, support the research and development of epidemic control and prevention products, contribute to the stability and renovation of supply chains and industrial chains, and ensure the normal import of production goods, which is especially vital for enterprises to go out of the woods and back to normal.

Notice of the National Development and Reform Commission of PRC on the Relevant Requirements for Formulating the List of IC Enterprises or Project and Software Enterprises Enjoying Preferential Tax Policies in 2022 (Fa Gai Gao Ji No. 390, [[][[]]2022])
In accordance with the Notice of the State Council on Issuing Several Policies on Promoting the Quality Development of the Integrated Circuit Industry and the Software Industry in the New Era (Guo Fa No. 8, [[][[]]2020], hereinafter referred to as the Several Policies) and the relevant provisions of the supporting tax policies, for the purpose of formulating the list of IC enterprises or project and software enterprises enjoying preferential tax policies in 2022, the relevant procedures and the conditions and project standards that enterprises need to meet to enjoy preferential tax policies are hereby notified.

Please note that the list mentioned in the notice refers to the list of IC production enterprises or projects involving integrated circuits with line widths less than 28 nm (inclusive), 65 nm (inclusive), and 130 nm (inclusive), which are encouraged by China and mentioned in Article 1 of the Several Policies.

Announcement No. 25 of the General Administration of Customs of 2022 (Announcement on Issuing 86 Industry Standards, including the Inspection Procedures of Imported Recycling Materials for Copper, and Repealing the Other Three)
The General Administration of Customs (GAC) issued 86 industry standards, including the Inspection Procedures of Imported Recycling Materials for Copper. The Quarantine Protocol for American Foulbrood of Honey Bees (SN/T 1168-2011) and the other seven replaced standards shall be repealed as of the date of entry into force of the new standards. The Method for Ethylene Oxide Fumigation Treatment for Tilletia Contraversa Kuhn in Wheat (SN/T 2016-2007) and the other two industry standards (see Annex 2) shall be repealed as of the date of promulgation of this Announcement.

Observations
In accordance with the provisions of the Announcement on the Relevant Matters concerning Regulating the Import Administration of Recycling Materials for Brass, Copper and Cast Aluminum Alloy (No. 43 of 2020), copper recycling materials that meet the national standards and do not belong to solid waste can be freely imported, and those that fail to meet the national standards are prohibited from being imported.

GAC Announcement No.29 of 2022 (Announcement on the Relevant Matters regarding the Customs Administration of the Zhangjiagang Bonded Port Area)
In accordance with the GAC Order on Issuing the Measures of the Customs of the Peoples Republic of China for the Administration of Comprehensive Bonded Zones (GAC Order No. 256), the relevant matters regarding the customs administration of the Zhangjiagang Bonded Port Area are hereby announced as follows:
1. Starting from April 1, 2022, the customs shall follow the Measures of the Customs of the Peoples Republic of China for the Administration of Comprehensive Bonded Zones (the Measures) to manage the Zhangjiagang Bonded Port Area. Paragraph 2 of Article 18 of the Measures does not apply to the Zhangjiagang Bonded Port Area. When relevant goods leave the Zhangjiagang Bonded Port Area for sale in China, the enterprise in the area or the consignee or consignor outside it shall undergo customs declaration formalities in accordance with the relevant provisions on the import of goods, and pay taxes based on the actual conditions of the goods when they leave the Area.
2. The Zhangjiagang Bonded Port Area shall be under closed-off management. Except for security personnel, no one is allowed to live in the area. It is forbidden to build commercial living or consumption facilities or engage in commercial retail businesses.
3. The various measures that are only implemented in comprehensive bonded zones to facilitate the supervision of the customs, issued by the GAC in accordance with the Several Opinions of the State Council on Boosting the High-Level Opening-Up and High-Quality Development of Comprehensive Bonded Zones (No. 3 [[][[]]2019] of the State Council), do not apply to the Zhangjiagang Bonded Port Area.
4. Infrastructure and supervision facilities such as fences and checkpoints that have been accepted in the Zhangjiagang Bonded Port Area shall not be changed at will. For changes indeed necessary, an application shall be filed with the local customs.

In accordance with the Measures for the Administration of the Customs Industry Standards of the People’s Republic of China (for Trial Implementation) (issued by the GAC Order No. 140 and revised following the GAC Order No. 235), the GAC issued the Rules for the Drafting of Customs Standards and the other two customs industry standards (see the annex) on March 30, 2022. These standards shall come into force as of October 1, 2022.

GAC Announcement No. 22 of 2022 (Announcement on Authorizing Local Customs to Carry Out the Quarantine Inspection and Approval of Entry Plant Products such as Grains)
Entry plant products whose entry quarantine inspection and approval have been authorized to local customs offices should be products whose trading has been approved by the quarantine access of China. Importers will follow the same way to apply for and go through the quarantine inspection and approval for the relevant plant products entering China.

The sales amount subject to VAT mentioned in this announcement includes sales amount for tax declaration, sales amount for inspection and compensation, and sales amount for tax assessment and adjustment. If the policy on VAT collection on a deducted base is applicable, it is the sales amount deducted by the difference that should be used for the calculation.

Announcement on Adding Registered New Chemical Substances into the Inventory of Existing Chemical Substances in China (first batch of 2022 of the Ministry of Ecology and Environment, the ninth batch in total)
Issued by the Ministry of Ecology and Environment (MEE) on March 2, 2022. In accordance with the requirements of the Measures for the Environmental Management Registration of New Chemical Substances (MEE Order No. 12) and the Announcement on Issuing the Guidance on the Environmental Management Registration of New Chemical Substances and the Relevant Supporting Forms and Instructions on Form Filling (MEE Announcement No. 51 of 2020), 18 registered new chemical substances meeting the requirements are hereby added into the Inventory of Existing Chemical Substances in China and shall be managed as existing chemical substances. For chemical substances marked with new usage environmental management scope, the new usage environmental management should be implemented.

Measures for the Supervision and Administration of Medical Device Operation (Order No.54 of the State Administration for Market Regulation)
The State Administration for Market Regulation (SAMR) issued the Measures for the Supervision and Administration of Medical Device Operation on March 22, 2022. The new measures consist of six chapters and 73 articles and shall come into force as of May 1, 2022. Please refer to the document for details. Notice of the Ministry of Transport and the NDRC on Reducing and Merging Port Fees and Other Relevant Matters (Jiao Shui Fa No. 26, [[][[]]2022])
