According to customs statistics, in the first two months of 2022, Chinas total import and export value was 6.2 trillion yuan, an increase of 13.3% over the same period last year (the same below). Among them, the export was 3.47 trillion yuan, an increase of 13.6%; Imports reached 2.73 trillion yuan, an increase of 12.9%; The trade surplus was 738.8 billion yuan, an increase of 16.3%. In dollar terms, Chinas total import and export value in the first two months was 973.45 billion US dollars, an increase of 15.9%. Among them, the export was 544.7 billion US dollars, an increase of 16.3%; Imports reached 428.75 billion US dollars, an increase of 15.5%; The trade surplus was 115.95 billion US dollars, an increase of 19.5%. Exports of mechanical and electrical products and labor-intensive products increased. In the first two months, China exported 2.02 trillion yuan of mechanical and electrical products, an increase of 9.9%, accounting for 58.3% of the total export value. Among them, there were 46.99 billion integrated circuits, worth 160.3 billion yuan, an increase of 24.8%, and 18.93 billion yuan of medical instruments and devices, an increase of 3.6%.

China-New Zealand FTA Upgrade Protocol

Chinas Minister of Commerce Wang Wentao and New Zealands Minister for Trade and Export Growth Damien OConnor had a video meeting recently. They announced that both sides had completed the domestic approval procedures for the Protocol on Upgrading the Free Trade Agreement between the Government of the Peoples Republic of China and the Government of New Zealand. Both of them agreed that the 50th anniversary of the establishment of diplomatic relations between China and New Zealand would be a great opportunity to implement the upgrade protocol with high quality. The China-New Zealand FTA Upgrade Protocol shall officially come into force as of April 7. The content of the Upgrade Protocol can be accessed on the FTA website of the Ministry of Commerce.

Observations

The Upgrade Protocol allows the higher quality and efficiency of the free-trade relationship between China and New Zealand based on the China-New Zealand FTA and the RCEP. It helps to further deepen the pragmatic cooperation between the two countries in all fields, reap benefits from high-level opening-up policies, promote the liberalization and facilitation of bilateral trade and investment, and continuously enrich the China-New Zealand comprehensive strategic partnership.

Notice of the Ministry of Finance on Adjusting the "Zero Tariff" Policy for Self-Use Production Equipment in the Hainan Free Trade Port (Cai Guan Shui No.4, [[][[]][[][[]]]2022])

For the purposes of further strengthening the policy effects and supporting the construction of the Hainan Free Trade Port, the Ministry of Finance made relevant adjustments to the "zero tariff" policy for self-use production equipment in the Hainan Free Trade Port starting from February 14, 2022. The adjustments include the following: 1. production equipment needed by the culture, sports, and tourism industries, such as carousels, swings, and other amusement park equipment, shall be added to the production equipment mentioned in Article 2 of the Notice of the Ministry of Finance, the General Administration of Customs and the State Taxation Administration on Adjusting the "Zero Tariff" Policy for Self-Use Production Equipment in the Hainan Free Trade Port (Cai Guan Shui No.7, [[][[]][[][[]]]2021]); 2. in accordance with the Cai Guan Shui Document No.7 of 2021, public institutions with an independent legal personality that registered in the Hainan Free Trade Port shall be exempted from customs duties, import value-added tax, and consumption tax when importing self-use production equipment within the scope of the Cai Guan Shui Document No.7 of 2021 and the aforementioned Article 1. Observations

The issuance of the self-use "zero tariff" production equipment policy will further reduce the tax burden of the Hainan Free Trade Port and encourage more foreign and domestic quality enterprises to operate there. The self-use "zero tariff" production equipment policy involves not only the processing industry, but also producer services such as research and development and inspection and maintenance, and services in which the Hainan Free Trade Port has an advantage, such as health care and culture, sports, and tourism. It will provide strong support to the development of the tourism industry, the modern service industry, and the high and new technology industry.

Announcement No. 7 of 2022 of the Ministry of Finance, the National Development and Reform Commission, the Ministry of Industry and Information Technology, the Ministry of Ecology and Environment, the Ministry of Agriculture and Rural Affairs, the Ministry of Commerce, the General Administration of Customs, and the Endangered Species Import and Export Management Office (Announcement on Adjusting the List of Imported Retail Goods for Cross-Border E-Commerce)

For the purposes of promoting the healthy development of cross-border e-commerce retail and meeting peoples needs for a good life, the List of Imported Retail Goods for Cross-Border E-Commerce (2019) will be optimized and adjusted starting from March 1, 2022. The adjustments include adding 29 commodities, deleting those under the customs code 93070090, and following the conversion of the Customs Import and Export Tariff and the adjustments to tax items to update the heading numbers of the commodities on the list and the remarks of a total of 206 goods. Observations

The addition of 29 commodities involve multiple product catalogs, such as food, textiles, wigs, machines, electrical equipment, furniture, game products, and sporting goods. For example, video game consoles and parts for which consumer demands remain strong are included in the positive list. This revision explicitly excludes prohibited goods for imports such as mercury-containing cosmetic products from the positive list and allows certificate-based release for products containing endangered species of fauna and flora, making the list management scope more regulated and precise.

Announcement of the General Administration of Customs, No. 16 of 2022 (Announcement on Implementing Mutual Recognition of Authorized Economic Operator (AEO) between Customs of China and the United Arab Emirates)

The customs of China and the United Arab Emirates officially signed the Mutual Recognition Arrangements of China Customs Enterprise Credit Management System and UAE Customs "Certified Operator" System between the General Administration of Customs of the Peoples Republic of China and the Customs of the United Arab Emirates (the Arrangements) in July, 2019. The Arrangements shall come into effect as of February 14, 2022. The relevant matters are hereby announced.

Observations

Import: A Chinese enterprise importing from a UAE AEO enterprise needs to fill in the latters AEO enterprise code in the Overseas Shipper Code field in the Overseas Shipper column of import declaration as well as in the Shipper AEO code field in the waterway or air cargo manifest. Format: country code (AE) + AEO enterprise code (7 digits). For example, AE1234567. China customs will grant the relevant facilitative measures after confirming the UAE enterprises AEO status.

Export: A Chinese enterprise exporting to the UAE needs to inform its UAE importer of its AEO code (AEOCN + the ten-digit enterprise code registered at China customs, e.g., AEOCN1234567890) so that the importer can declare following the provisions of the UAE customs. The UAE customs will grant the relevant facilitative measures after confirming the Chinese enterprises AEO status.

The customs of China and Russia signed the Arrangement on Mutual Recognition of "Certified Operators" between the General Administration of Customs of the Peoples Republic of China and the Federal Customs Service of the Russian Federation

During the meeting between Chinese President Xi Jinping and his Russian counterpart Vladimir Putin on February 4, 2022, the customs of China and Russia signed the Arrangement on Mutual Recognition of "Certified Operators" between the General Administration of Customs of the Peoples Republic of China and the Federal Customs Service of the Russian Federation (Certified Operators are Authorized Economic Operators, hereinafter referred to as "AEO enterprises"). Goods imported and exported by AEO enterprises of the two countries will enjoy priority customs clearance, priority inspection, application of a lower document review rate and inspection rate, and other facilitative measures during customs clearance, thus substantially reducing enterprises trade costs in warehousing and logistics, among others. The AEO mutual recognition between China and Russia will further promote the safety and smoothness of the two countries supply chains and build a more secure and accessible environment where both countries can strengthen the foundation of their cooperation in energy and continuously expand trade and investment scale. China-Russia bilateral trade grew 26.6% year on year to 948.66 billion yuan, exceeding 900 billion yuan for the first time, securing Chinas position as the largest trading partner of Russia for the 12th consecutive year.

Up to now, China has signed AEO mutual recognition agreements with 22 economies, such as Singapore, the European Union, and South Africa, covering 48 countries and regions, leading the world in the number of mutually recognized countries and regions, including 32 "One Belt, One Road" countries, five RCEP member states, and 13 central and Eastern European countries.

With Russia being a fundamental member of the Eurasian Economic Union, the AEO mutual recognition between China and Russia will further play a diffusion and driving effect to help enhance the economic and trade cooperation between China and the Eurasian Economic Union.

Announcement of the Customs Tariff Commission of the State Council (CTCSC) on Implementing RCEP Conventional Tariff Rates to Some Goods Imported from Malaysia (CTCSC Announcement No. 2, [[][[]][[][[]]]2022])

Under the relevant provisions of the Regulations of the Peoples Republic of China on Import and Export Duties and the Regional Comprehensive Economic Partnership (RCEP) and the entry into force of RCEP for Malaysia, RCEP conventional tariff rates applicable for ASEAN member states will be imposed on some import goods originating in Malaysia starting from March 18, 2022. The tariff rates are specified in the Conventional Tariff Rates field of the Customs Import and Export Tariff of the Peoples Republic of China (2022) (annex of the CTCSC Announcement No. 10 of 2021) and are abbreviated as 东盟R (ASEAN R) in Chinese. So far, RCEP will enter into force for 12 of the 15 RCEP signatories, leaving only three ASEAN member states that have not yet ratified the agreement, namely, Indonesia, Myanmar, and the Philippines. The HMGs commodity management system has been updated as required and will be available for all clients.

Notice of the Shanghai Municipal Commission of Commerce on Issuing Several Measures of Shanghai on Implementing RCEP with High Quality (Hu Shang Zi Mao No. 24, [[][[]][[][[]]]2022])

For the purposes of driving Shanghai to build opening up for international cooperation and new competitive advantages in depth, implementing the Guiding Opinions on Implementing RCEP with High Quality (Shang Guo Ji Fa No. 10, [[][[]][[][[]]]2022]) released by the Ministry of Commerce and five other departments, seizing new opportunities for an open economy, and fostering new driving forces for high-level opening-up and high-quality development, the Shanghai Municipal Commission of Commerce issued relevant measures on February 18, 2022. Observations

Shanghai intends to encourage local enterprises to strengthen, consolidate, and renovate the supply chain and industrial chain to achieve high efficiency, seize the opportunities produced by the further opening up of RCEP members in foreign investment, increase investment and cooperation in the fields of agricultural resources, biologic pharmacy, telecommunication, green energy, and infrastructures focused on significant countries and regions such as Singapore, Indonesia, and Japan, and promote adjustments in economic structure and industrial transformation and upgrade. It plans to provide guidance and support to overseas economic and trade cooperation zones so that they can play a greater role under the RCEP framework, encourage enterprises in the Yangtze Delta Area to go abroad and settle overseas in groups, and strengthen the interconnected development of domestic and overseas industrial clusters in a comprehensive manner.

Notice of the State Taxation Administration on Issuing the 2022A Version of the Export Tax Refund Rate Library (Shui Zong Huo Lao Han No. 20, [[][[]][[][[]]]2022])

In 2022, the tax items in Chinas Customs Import and Export Tariff were converted to the local version promptly according to the Harmonized Commodity Description and Coding System of the World Customs Organization. The State Taxation Administration (STA) compiled the 2022A Version of the Export Tax Refund Rate Library (the Library) with reference to the adjustments to customs import and export tariffs and customs codes. The relevant matters are hereby notified as below:

1. The Library is available on STAs controlled FTP (100.16.92.60) under the directory Published Procedures. Please download it in time, upgrade the export tax refund inspection system accordingly, and send the Library to exporters in time.

2. All local authorities shall apply the export tax refund rates strictly. Changes of rates without approval are strictly prohibited. Once found, the parties involved will be held accountable.

3. Please report to the Goods and Services Tax Department of the STA promptly for issues found in the implementation.

Announcement of the National Medical Products Administration (NMPA) on Issuing the Guideline for Writing Technical Requirements for Medical Devices (No. 8 of 2022)

For the purposes of making technical reviews for medical devices more standard and scientific and providing guidance to medical device registrants/filers regarding the writing of product technical requirements, in accordance with the provisions of the Regulations on the Supervision and Administration of Medical Devices, the Administration Measures for the Registration and Filing of Medical Devices of the State Administration for Market Regulation, and the Administration Measures for the Registration and Filing of In-Vitro Diagnostic Reagents, the NMPA organized the revision of the Guideline for Writing Technical Requirements for Medical Devices starting from February 8, 2022. Notice of the Department of Comprehensive Affairs of NMPA on Issuing the Inspection Procedures of the Quality Management System for the Registration of Domestic Class III Medical Devices (Yao Jian Zong Xie Zhu No. 13, [[][[]][[][[]]]2022])

For the purpose of improving the inspection of the quality management system for the registration of medical devices, in accordance with relevant regulations such as the Regulations on the Supervision and Administration of Medical Devices, the Administration Measures for the Registration and Filing of Medical Devices of the State Administration for Market Regulation, and the Administration Measures for the Registration and Filing of In-Vitro Diagnostic Reagents, the NMPA organized the revision of the Inspection Procedures of the Quality Management System for the Registration of Domestic Class III Medical Devices starting from February 9, 2022. The Procedures have a total of 23 articles. Please refer to the annex of the notice for details. Notice of the Department of Comprehensive Affairs of NMPA on Issuing the 2022 National Medical Devices Spot Inspection Plan (Yao Jian Zong Xie Guan No. 15, [[][[]][[][[]]]2022])

In accordance with the Notice of the Department of Comprehensive Affairs of NMPA on Carrying Out the 2022 National Medical Devices Spot Inspection (Yao Jian Zong Xie Guan No. 108, [[][[]][[][[]]]2021]), the Department of Comprehensive Affairs of NMPA published the 2022 National Medical Devices Spot Inspection Plan on February 22, 2022. Argentina Adopted Anti-Dump Measures against Multiple Products from China.

The Economic and Commercial Office of the Embassy of the Peoples Republic of China in the Argentine Republic was informed by the Undersecretariat of Commercial Policy and Administration of the Ministry of Productive Development of Argentina on February 8, 2022, that in accordance with the Resolution No. 40/2022 thereof, they had decided to launch an anti-dump investigation against electric storage water heaters originating in China, impose an ad valorem tax of 131% over the FOB values of the aforementioned goods as an anti-dump measure, and accept the price commitment proposed by Wuhu Midea Kitchen & Bath Appliances Mfg. Co. Ltd, Guangdong Vanward Electric Co. Ltd, and Guangdong Gemake Electric Appliance Co. Ltd. The relevant measures will remain in force for a period of 5 years.

The Economic and Commercial Office of the Embassy of the Peoples Republic of China in the Argentine Republic was informed by the Undersecretariat of Commercial Policy and Administration of the Ministry of Productive Development of Argentina on February 25, 2022, that in accordance with its Resolution No. 90/2022 made on February 23, 2022, they had decided to end the review of the anti-dump investigation against food processors originating in China and Brazil. They decided to maintain the measures determined by Resolution No. 314 made by the former Ministry of Production on July 5, 2016, against food processors originating in China and Brazil. The resolution shall come into force as of the date of promulgation and remain valid for a period of five years.

Observations

The Argentine government has adopted a series of restrictive measures against products imported from China in the past few years. The latest statistics report released by the National Institute of Statistics and Census of Argentina shows the bilateral trade between the two countries totaled 8.829 billion U.S. dollars in 2009, down 35.8% compared with 2008. To deal with trade disputes, the Chinese government has repeatedly stressed that we should oppose trade protectionism, boost the recovery of the world economy, and in particular, stand against the tendency of developed economies such as the United States and Europe to overuse trade remedy measures. In the meantime, China also stated that it would make adjustments to take care of mutual interests and concerns and resolve its conflicts and disputes with some developing countries.

Announcement No. 507 of the Ministry of Agriculture and Rural Affairs and the General Administration of Customs

In accordance with the Regulations on Administration of Veterinary Drugs and the Measures for Administration of Veterinary Drug Imports, the Ministry of Agriculture and Rural Affairs and the General Administration of Customs revised the Catalog for Management of Imported Veterinary Drugs, which is hereby promulgated and shall come into force as of February 10, 2022. The Announcement No. 369 of the Ministry of Agriculture and Rural Affairs and the General Administration of Customs shall be simultaneously abolished. To import veterinary drugs, importers should apply for the Customs Clearance Form for Imported Veterinary Drugs to the Ministry of Agriculture and Rural Affairs or a competent stockbreeding and veterinary authority governed by a provincial peoples government. Importers can go through the import formality at the customs by showing the Customs Clearance Form for Imported Veterinary Drugs.
